AI for real estate agents pays off where the same writing work comes back every week: listing copy from your property data, sorting portal inquiries and preparing replies, scheduling viewings, document checklists, follow-ups after a viewing and replies to reviews. All of it ends as a draft that you check. Price, negotiation, choosing the buyer or tenant and everything you are liable for stay with you. Two points are mandatory: the energy certificate details in the listing must be right, and a photo furnished by AI must not pass as a real photo. The legal parts of this article refer to German law.
I run my business with fourteen AI employees, each with a personnel file, fixed limits and a human who approves. There is no documented agency case on this page; the workflows below are examples that transfer roles from my business to an agent's office.
What AI can take over for real estate agents
Listing copy with AI: from facts, not fantasy
An example: for a three-room apartment you give the AI the data sheet with floor area, year of construction, heating and the energy certificate values, plus your walkthrough notes and the photos. You get back a draft of description, features and location. Anything not in your documents gets flagged, not invented.
Under § 5 of the German Unfair Competition Act (UWG), untrue or deceptive statements about, among other things, the condition of the goods are misleading. "Quiet location" or "freshly renovated" only belong in the listing if you can back them up. How to teach the AI your tone is in Writing with AI: A Beginner's Guide.
Mandatory details: the energy certificate in the listing
I'm a developer, not a lawyer, and this isn't legal advice.
The mandatory details are set out in § 87 of the German Buildings Energy Act (GEG), which since 29 July 2026 has been called the Buildings Modernisation Act (Gebäudemodernisierungsgesetz, GModG). If an energy certificate exists for a sale or rental and the agent is responsible for the listing in commercial media, the version in force until the end of 2026 requires:
- the type of energy certificate, demand-based or consumption-based,
- the final energy demand or final energy consumption value,
- the main energy sources for heating,
- for residential buildings, the year of construction from the certificate,
- for residential buildings, the energy efficiency class.
For non-residential buildings, heat and electricity are listed separately. Failing to ensure these details intentionally or with gross negligence is an administrative offense under § 108, with a fine of up to ten thousand euros.
The list changes on 1 January 2027. For certificates issued from then on, the new § 87 requires whether the certificate is demand- or consumption-based (§ 81 or § 82), the issue date, the annual primary energy demand in kWh per square metre and year, the efficiency class, the year of construction and the main heating energy sources. Older certificates keep the five details above (§ 112(3) and (4), new version). For the AI, the checklist depends on the certificate's issue date; values come word for word from the certificate, and if it is missing, the draft shows a note instead.
Sorting and answering portal inquiries
Suppose a new listing gets many inquiries over its first weekend. An AI can sort them into piles: complete inquiries asking for a viewing, questions it can answer from the listing, inquiries with missing details, and cases for you, such as questions about a price reduction or financing. Each pile gets a draft reply.
I know the pattern from my own inbox: Frieda sorts my inbox into four piles plus a fifth pile for cases that need my judgment, and she has never sent anything on her own: every reply stays a draft until I approve it. More on Frieda, my AI employee for the inbox and in Sorting Your Inbox: The Pile System.
One limit belongs in every sorting rule: the AI sorts by request and completeness, never by name, origin or similar characteristics. The German General Equal Treatment Act (AGG) expressly covers access to housing (§ 2(1) no. 8 and § 19 AGG). Taking inquiries by phone instead is covered in AI Receptionist: Providers, Pricing, Law.
Viewings and document checklists
For viewings, the AI can propose slots from your calendar and draft the confirmation and a reminder. What already works today is in Scheduling Meetings With AI: What Works Now.
An example checklist for selling a condominium: land register extract, declaration of division, floor plans, floor area calculation, minutes of the owners' meetings, energy certificate. The AI keeps the list per property and flags what is missing. German law sets one deadline: under § 80(4) GModG you show the energy certificate to the prospective buyer "at the latest during the viewing", and a clearly visible display during the viewing is enough.
Following up after the viewing, and reviews
Sonja, who prepares business emails for me, shows the pattern: she checks every fact against the source, brings the text to my language level and drops it into my inbox as a draft, and nothing goes out until I say so explicitly (Sonja at work). For an agency, property, date and open questions come from your notes. When and how often to follow up is in How to Follow Up on a Quote by Email.
The same applies to reviews: the AI drafts, you post. Templates are in Respond to Google Reviews With AI.
AI images and virtual staging
Virtual staging, an empty room furnished by AI, needs two rules.
Make it recognizable. Under § 5(4) UWG, "pictorial representations" also count as statements, so an embellished photo can mislead just like a sentence. The EU AI Act, as amended by Regulation (EU) 2026/1744, adds a second rule. Under Article 3(60), a deep fake is AI-generated or manipulated image content "that resembles existing persons, objects, places, entities or events and would falsely appear to a person to be authentic or truthful". A realistically furnished photo of a real apartment can fall under this. Then, as the deployer, you must under Article 50(4) "disclose that the content has been artificially generated or manipulated", and that has applied since 2 August 2026. In practice: a note such as "Visualization, virtually furnished" on the image and in the caption, with the unfurnished original next to it. More on Article 50 in AI Disclosure Rules Under the EU AI Act.
Do not retouch defects. Adding furniture is different from removing damp stains, cracks or the view of the railway line. That concerns the property's condition, exactly what § 5 UWG protects. So the instruction to the image tool says: change nothing about the building, only furnish.
Prospect data and privacy
Inquiries, tenant self-disclosures and proof of income are personal data. Two GDPR rules carry the workflow: data must be "limited to what is necessary in relation to the purposes for which they are processed" (Art. 5(1)(c)), and an AI service that processes them for you needs a data processing agreement under Art. 28. Give the AI only what the task requires. How I decide what an AI gets to see is in AI and Privacy: What the AI Gets to See.
The brokerage contract under German law: text form, withdrawal, equal split
The AI can fill drafts from your template; the template itself belongs in professional hands. Three points from the German Civil Code (BGB):
- Text form. A brokerage contract for the purchase of an apartment or a single-family house requires text form (§ 656a BGB).
- Withdrawal. If the contract with a consumer is concluded only by email, phone or portal, it can be a distance contract (§ 312c), with a 14-day right of withdrawal (§§ 312g, 355). The period does not start before the consumer has been informed (§ 356(3)). The AI never changes the withdrawal notice in the template.
- Equal split. When a consumer buys an apartment or a single-family house, §§ 656c and 656d apply: commission from both sides only in the same amount, and whoever passes the commission on to the other side must still pay at least the same amount. Commission details in the listing come from your contract.
What does not go to the AI
Price and valuation, the negotiation, the decision on who gets the apartment, any legal assessment and the sending. In my business this is a fixed rule for proposals: Anton drafts, I approve, and no offer and no invoice leaves the system without my click (Anton, proposals and invoices).
Frequently asked questions
Can I write listing copy with AI?
Yes, and you remain responsible. Every detail must be correct (§ 5 UWG in Germany), and the energy certificate details under § 87 GModG must be complete. Let the AI write only from your documents and flag gaps. This isn't legal advice.
Do I have to label virtual staging?
If it looks like a real photo of the apartment, it can be a deep fake under the EU AI Act, and Article 50(4) requires disclosure. A visible note on the image is the safe house rule. This isn't legal advice.
Which energy certificate details belong in a German property listing?
For certificates issued before 2027: type of certificate, final energy demand or consumption, main heating energy source and, for residential buildings, year of construction and efficiency class (§ 87(1) GModG, formerly GEG). For certificates issued from 1 January 2027, the issue date and annual primary energy demand are added, and the efficiency class and year of construction apply to all buildings.
Can I enter prospect data into ChatGPT or Claude?
Only into a service with a data processing agreement, and only as much as the task requires. This isn't legal advice.
How to continue
Start with one task. If inquiries pile up, start with sorting. If listings eat your evenings, start with a fixed data sheet per property, including the mandatory energy certificate fields. How an AI employee comes together, from task to approval, is in Hiring an AI Employee: The Process. What the path from first call to proposal looks like with AI is shown in AI in Sales: From Call to Proposal.
