How to start a private practice as a therapist, counselor or psychologist in the US comes down to a short list before the first client: an active license from your state board, a business structure, an EIN if you need one, and an NPI plus HIPAA compliance if you'll bill insurance electronically. Then the office starts: website, getting found nearby, invoices for workshops and talks, expense receipts, the admin inbox. You can set that up from day one so AI employees do the prep work and you approve. Client invoices and superbills stay in your practice management software. Training and licensing exams aren't covered here.
This is not legal or tax advice. The US points refer to federal sources and one state example as of November 2026; your state and your licensing board add their own rules. How AI employees fit into a therapy office in general, and where client data stops, is in AI Tools for Therapists: Office, Not Therapy.
How to start a private practice: what has to be in place first
License. Licensure is a state matter. In California, for example, the Board of Behavioral Sciences is "responsible for licensing, examination, and enforcement of professional standards" for marriage and family therapists, clinical social workers and professional clinical counselors. Ask your board what it expects before you sign a lease.
Business structure. The IRS puts it plainly: "The most common forms of business are the sole proprietorship, partnership, corporation, and S corporation. A limited liability company (LLC) is a business structure allowed by state statute." Which one fits is a question for your CPA or attorney.
EIN. The IRS says you generally need an employer identification number to hire employees or run a partnership or corporation. If you create a corporation or LLC, form it with your secretary of state first. Applying online is free: "You never have to pay a fee for an EIN."
NPI and HIPAA. Under 45 CFR 160.103, a covered entity includes "a health care provider who transmits any health information in electronic form in connection with a transaction covered by this subchapter", insurance claims being the typical case. A covered health care provider must obtain an NPI and use it on standard transactions (45 CFR 162.410). If you plan to take insurance, get the NPI before your first claim.
Good faith estimates. Under 45 CFR 149.610, providers have to inform uninsured or self-pay clients that a good faith estimate of expected charges is available "upon scheduling an item or service or upon request". That notice must be "prominently displayed (and easily searchable from a public search engine)" on the provider's website.
What you can run yourself from day one
My thinking for the practice office: be in charge yourself instead of needing a service provider for every small change. AI employees do the prep work by your rules, and nothing goes out without your approval. The roles below run in my own business in Germany. I don't have an AI case from a newly opened practice, so applying them is a proposal:
Ralf has built more than 20 client websites and also maintains kevinwelter.com technically. He can develop a new website from a brief, images and verified business information, without an existing site. Launch only after your approval. A real case from Germany, without names: Ralf built the website of a licensed couples therapist.
The brief for a new practice: services, how a first session works, fees, location, your exact license title. Before launch, check it against your board's advertising rules, promise no outcomes, and put the good faith estimate notice in place. What ethics codes, the FTC and HIPAA rule out in marketing is in Marketing for Therapists: Rules and Tactics. Building the practice site yourself instead of hiring an agency is in Therapist Website Templates or Your Own Site.
Getting found nearby: Sebastian
Sebastian is my AI employee for SEO, GEO and blogging. His page lists local businesses among his uses; he puts nothing live himself. For your practice, a new workflow you describe: create and verify a business profile, keep name, address and phone number identical everywhere, one page per service. The details are in How Do I Get Found on Google? Local SEO.
Invoices: clients in the practice software, the rest through Anton
An invoice or superbill for a client shows treatment, and for a HIPAA covered entity it's protected health information. It's created in your practice management software and stays there; see Therapy Notes Software for Psychotherapists.
For income without client data, say a workshop for an employer or a talk at a community center, Anton fits. He runs in my own business and, once a client says yes, creates the contact, offer and invoice as drafts in Lexware Office, or through a self-built adapter in another accounting tool. The invoice is always created in the accounting tool, never as a loose PDF, and nothing leaves the system without your click. Connecting your US accounting tool is a new workflow. What a client invoice needs is in Therapy Invoice Template: What to Include. Settle your cancellation policy before the first session; see Therapy Cancellation Policy: What to Write.
Receipts from day one: Peter
Peter has been running in my business since August 19, 2026. He works in my bookkeeping interface in the browser: he screens newly arrived receipts, assigns each one the correct receipt type, matches the credit card statement line by line and reports what doesn't add up. He doesn't book entries. New workflows start in a learning mode in which he only reads and takes screenshots.
In a practice, Peter gets expense receipts only: furniture, software, rent, continuing education, insurance. IRS Publication 583 says: "One of the first things you should do when you start a business is open a business checking account." Receipt types and what counts as open are the new workflow you describe. Your accountant has to be part of it; Peter's page says you define "the handoff format, responsibility boundaries and review steps" together. More in Bookkeeping for Therapists: What AI Prepares.
Admin inbox: Frieda
Frieda runs in my own business and sorts the inbox into four piles, Now, Today, Can wait and Trash, plus a fifth for cases that need my judgment. She has never sent anything on her own. Health is off-limits under her instructions.
For a new practice: two inboxes from day one. Landlord, software vendors, your licensing board and continuing education go into the admin inbox, which Frieda sorts. Client inquiries stay with you; she can prepare templates that you send yourself. More in Sorting Your Inbox: The Pile System.
Opening a practice in Germany
In Germany, anyone who wants to practice healing without being a licensed physician needs a permit under § 1 of the Heilpraktikergesetz; the title Psychotherapeut requires the Approbation under § 1 PsychThG. The health office gets notice under state law; Bavaria's Art. 10(3) GDG requires it without undue delay, with proof of the permit and of adequate liability insurance. Heilpraktiker are a liberal profession under § 18 EStG, so they notify the tax office and file the tax registration questionnaire through ELSTER within a month (§ 138 AO). The small business rule is in German Small Business Invoices: The Rules, practice software in Naturopath Practice Software: How to Choose.

Frequently asked questions
What do I need to start a private practice?
An active license from your state board, a business structure, an EIN if you hire staff or run a partnership or corporation, and an NPI if you'll bill insurance electronically. Add a business checking account.
Do I need an LLC to start a private practice?
Not by default. The IRS lists the sole proprietorship among the most common forms; an LLC is allowed by state statute. Ask your CPA or attorney.
Can an AI write client invoices?
Not in this setup. Client invoices and superbills show treatment (protected health information if you're a covered entity) and stay in your practice management software. Anton only drafts invoices without client data, such as for workshops and talks.
